Terms & Conditions
I, the undersigned, wish to volunteer for a Jimmy Fund event(s) that is/are taking place between January 1, 2025 and December 31, 2025 (the “Event(s)”). I acknowledge and agree that if the Event(s) is cancelled or postponed to another date for any reason, all agreements, representations, warranties and attestations contained herein will apply with equal force to the Event(s). If I am unable to volunteer on the rescheduled date, I will immediately contact the Event Volunteer Coordinator, whose contact information can be found on the respective event page on https://www.jimmyfund.org/events/volunteer/, under the “Events and Programs” section.
I represent and warrant that I am physically fit and healthy to participate as a volunteer for the Event(s), and that my participation is entirely voluntary. Without limiting the foregoing, I will not participate in the Event(s) if, within the 48 hours preceding the Event(s), I have experienced any symptoms of COVID-19, influenza, norovirus, or any other infectious disease (including, but not limited to, fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle aches, headache, new loss or taste or smell, sore throat, congestion or runny nose, nausea or vomiting, and diarrhea). To the extent applicable, we ask that participants make reasonable efforts to adhere to any applicable federal, state, or local public health guidelines in effect at the time of the Event(s). I agree to use good judgment in all aspects of my participation in the Event(s), to behave appropriately, and to comply with the rules for volunteering, if any.
I understand that participating as a volunteer for the Event(s) exposes me to certain risks, which may include, but are not limited to, injury, illness, death, and damage to self and/or property, whether from possible exposure to infectious diseases, including, but not limited to, COVID-19, exertion, weather conditions, the conditions of the course, vehicular traffic, and contact with other participants. I hereby assume and take full responsibility for any and all risk of harm, injury, illness, death, or damage to myself and/or my property that may occur in connection with my participation as a volunteer for the Event(s).
I hereby grant permission for photographs, videos, and other images (collectively, the “Images”) to be taken of me during the Event(s) and assign all rights and interests to the Images to Dana-Farber Cancer Institute, Inc. (“DFCI”). I understand that the Images may be used by DFCI and/or its designees in connection with its advertising, promotional and marketing activities, and for other purposes authorized by DFCI, including, but not limited to, use in direct mail marketing, print advertising, posters, billboard advertising, and the internet; all without any compensation to me.
In consideration of my being permitted to participate as a volunteer for the Event(s), I hereby, for myself, and on behalf of my heirs, executors and assigns, waive, release and forever discharge DFCI, DFCI’s affiliates, and their respective officers, trustees, employees, sponsors, coordinating groups, other volunteers, representatives and agents, and all others in any way associated with the Event(s) (collectively, the “Released Parties”) from any and all liability, claims, damages, or rights of action of whatever nature or description, in equity or at law, present or future, resulting from or relating to my participation as a volunteer for the Event(s). This means that I will not sue DFCI or any of its affiliated persons or entities, or try to hold them legally or financially responsible, for any harm or injury that might relate to my taking part as a volunteer for the Event(s).
I hereby attest that by signing this waiver/agreement and registering as a volunteer for the Event(s), I have read, fully understand, and agree without exception to all the provisions, releases, and waivers outlined in this Volunteer Agreement and General Release / Waiver form, and that I have agreed to it knowingly and voluntarily. I understand that this agreement is a legally binding document that limits the legal liability of the Released Parties. I attest, under penalty of fraud, that I am at least 18 years of age at the time of registering, and if I am registering on behalf of a minor, that I am the minor’s parent or legal guardian. If I am registering on behalf of a minor, I agree that the minor will be accompanied by an adult who is to be responsible for them at the Event(s).
This Release must be signed prior to participating as a volunteer for the Event(s).
NOTE: A legal guardian must be appointed or approved by the court. A legal guardian only may grant permission for the minor to participate in the Event(s). For example, a camp counselor, or school chaperone is not a legal guardian for children under his or her supervision, and may not grant permission, but may serve as the accompanying adult to the minor at the Event(s).
